Firm defeats claim of woman injured at movie theatre

BOSTON (Sept. 2, 2009) – Associate Scarlett M. Rajbanshi recently persuaded a jury to reject the claim of a Massachusetts woman injured in a movie theatre.

The 24-year-old woman suffered dental and facial injuries after striking a hand rail mounted in the center of an aisle of a darkened stadium-style auditorium during the showing of a movie.

The woman denied tripping, and alleged that the movie theatre chain negligently failed to illuminate the hand rail. But the western Massachusetts jury after only 30 minutes of deliberation returned a verdict in favor of the movie theatre chain, which owns the facility.

“I asked the jury, ‘how did she hit the hand rail if she didn’t trip? Does her story make any sense?’ I think the jury determined that her version of events just didn’t ring true,” Rajbanshi said.

The trial was held in the Northampton District Court before Judge Richard J. Carey.
