Coulam wins appeal in employment case

PROVIDENCE (May 24, 2010) – Andrew C. Coulam recently persuaded the Review Board of the Rhode Island Department of Labor and Training to reject an unemployment claim of a former employee of a Rhode Island health care group.

After an administrative hearing, the Review Board reversed the Department’s earlier ruling in favor of the former employee, who sought unemployment benefits after being discharged for suspected embezzlement. In doing so, the Review Board referred to the testimony of the employer’s fact witnesses and the employer’s formal investigation, both of which confirmed the suspicion of embezzlement.

"This is the right result for our client,” Coulam said. “The law is clear that an individual is not entitled to unemployment benefits if he or she engaged in misconduct.”
