Andrew R. WeinerAndrew R. Weiner is an experienced civil litigator with a focus on medical malpractice, professional liability, insurance and reinsurance coverage issues, and employment law. He appears regularly in courts in Massachusetts and Rhode Island. Representative AccomplishmentsMr. Weiner successfully persuaded the Massachusetts Commission Against Discrimination to dismiss a disability discrimination claim filed against a non-profit organization by one of its former employees. He also recently teamed with Pamela S. Gilman in persuading a Massachusetts Superior Court jury to reject a woman’s “wrongful birth” claim. The jury needed less than an hour following the two-week trial to deliver its verdict that the firm’s client, a physician assistant, was not negligent. Mr. Weiner recently persuaded a judge in the Business Litigation Session of the Massachusetts Superior Court to dismiss a consumer protection claim against an accounting firm. The judge took the unusual step of dismissing the claim of the plaintiff early in the case before discovery had taken place. At the appellate level, Mr. Weiner played an instrumental role in successfully representing the New England Organ Bank in a landmark case in which the Massachusetts Supreme Judicial Court, as a matter of first impression, affirmed the dismissal of a negligence lawsuit against the organ bank based on the good faith immunity provision of the Uniform Anatomical Gift Act. The Court’s opinion established new law in Massachusetts on applying the good faith immunity standard. Carey v. New England Organ Bank, 446 Mass. 270 (2006).
