Brendan T. Malvey

Mr. Malvey is an experienced civil litigator with a focus on premises liability, professional liability, construction litigation, insurance coverage and employment law.

Representative Accomplishments

Mr. Malvey recently persuaded a Massachusetts District Court judge to dismiss a lawsuit against the firm’s client, a company that provides in-home non-medical services to the elderly. He successfully argued that the plaintiff, who was the son of a woman formerly served by the company, lacked standing to sue the company for breach of contract and related damages. On behalf of an employer, Mr. Malvey successfully dismissed a personal injury claim brought by an employee who was attempting to invoke exceptions to the exclusivity provision of the Massachusetts Workers’ Compensation Act.  Following a bench trial before the Massachusetts Department of Industrial Accidents, he also successfully persuaded an administrative judge to deny a former employee’s claim for workers’ compensation benefits and medical treatment following a severe back injury.

He has handled high-stakes cases, including obtaining a favorable settlement on behalf of a workers’ compensation client facing potentially high-exposure liability. Mr. Malvey was instrumental in obtaining a low-cost settlement of an employment discrimination suit in federal court following his preparation and submission of a summary judgment motion and memorandum of law. In a construction dispute, he successfully negotiated a dismissal of all claims against an excavation contractor for damage to underground facilities owned by a national telecommunications company.
