Edward D. ShoulkinEdward D. Shoulkin is a skilled trial and appellate attorney with 20 years of experience in a broad range of litigation matters. He represents multinational corporations, small businesses and individuals in business disputes, construction litigation, product liability cases, environmental litigation, and insurance coverage matters. Mr. Shoulkin has particular expertise in defending professionals in civil disputes and disciplinary proceedings, including accountants, health care providers, financial advisors and attorneys. Clients rely on Mr. Shoulkin’s skills and experience in achieving favorable outcomes at trial, as well as through dispositive motions and alternative dispute resolution. His consulting services also assist clients in risk management, litigation avoidance, and resolution of professional ethics issues. Mr. Shoulkin has served as a lecturer on trial practice, risk management and professional liability topics. Representative AccomplishmentsMr. Shoulkin has successfully dismissed claims against accounting firm clients in a variety of cases. For example, he obtained a court order dismissing various claims related to an accounting firm’s fraud investigation of a client’s employee. He secured the dismissal of an accounting firm embroiled in a lawsuit involving a minority shareholder dispute. He also recently persuaded a judge in the Business Litigation Session of the Massachusetts Superior Court to dismiss a consumer protection claim against an accounting firm. The judge took the unusual step of dismissing the claim of the plaintiff early in the case before discovery had taken place. In a business litigation matter, Mr. Shoulkin successfully obtained injunctive relief to enforce a non-competition clause against former employees who had wrongfully taken the client’s customer lists to start a new business. Representing an attorney who had been suspended indefinitely from the practice of law for allegedly commingling and converting client funds, Mr. Shoulkin successfully persuaded a hearing panel of the Massachusetts Board of Bar Overseers to reinstate the attorney's license. In the medical malpractice area, Mr. Shoulkin successfully defended a health care provider at arbitration against drug toxicity claims. He obtained a defense verdict at trial for an orthopedic surgeon in a case alleging wrongful death. Mr. Shoulkin also obtained an arbitration victory for a medical provider against claims the provider negligently failed to diagnose prostate cancer. Professional and Civic AffiliationsMr. Shoulkin is a member of the Massachusetts Bar Association and Defense Research Institute. Mr. Shoulkin is active in his community as well. He serves on the Board of Trustees of Temple Beth Elohim, and is a member of the Temple's Bikur Cholim committee, providing support to those faced with serious illness, injuries, and issues of continuing treatment. Mr. Shoulkin has also served as a member of a pastoral care committee, whose mission is to evaluate and improve the care and services provided to congregational members and their families in times of need. Mr. Shoulkin has also enjoyed serving for five years as a den leader for a Cub Scout pack of the Boy Scouts of America. |
